Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of kibley.com and the Kibley studio (the “Service”). By creating an account or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1. The service

Kibley is a studio for e-commerce sellers that turns product photos into AI-generated images for commercial use. You upload your own product photos, or import them directly from your store or a product page, and Kibley generates new images, including lifestyle scenes and model shots, from that material.

The exact style, composition, and quality of what we generate depend on the material you provide and the AI models we use. We do not guarantee a specific creative outcome for any individual generation.

2. Accounts

You need an account to use the Service. We use Clerk to handle sign-in: you can sign in with a one-time code sent to your email, or with your Google account. We do not ask for or store a password.

You are responsible for keeping your account secure and for all activity that happens under it.

3. Plans, images, and billing

Kibley runs on a subscription. Every paid plan includes a monthly allowance of images. A 4K image is larger and costs more to produce than a Standard image, so it draws four times as much from your allowance. Internally the allowance is metered in credits: a Standard image uses 5 credits and a 4K image uses 20.

The Free plan is enabled automatically when you sign up and includes a one-time grant of 20 credits, which is 4 Standard images or 1 in 4K. It does not renew, so once those credits are used you need a paid plan to create more images. Paid plans are Starter ($39/month, 100 Standard images or 25 in 4K), Growth ($79/month, 300 Standard images or 75 in 4K), and Pro ($179/month, 900 Standard images or 225 in 4K). Annual billing is available on paid plans at a discount of roughly 20% compared to paying monthly.

On paid plans, credits reset at the start of each billing interval and do not carry over. Payments are processed by Stripe, and your subscription and credit balance are managed through our billing partner, Autumn. We never see or store your full card details.

Fees are non-refundable except where required by law. You can upgrade, downgrade, or cancel your plan at any time from your account settings.

4. Your content

You keep ownership of everything you upload or import: your product photos, brand details, and any other material. By uploading or importing that material, you grant Kibley a license to host, store, and process it for the purpose of generating your images and operating the Service.

You confirm that:

• You own or have the rights to the material you upload or import.
• Your content doesn't infringe anyone else's copyright, trademark, or privacy rights.
• The products shown are legal to sell in your market.

When you import from a store or product URL, we fetch the publicly available product details and photos from that page on your behalf.

5. Your generated images

Once an image is generated, you receive a worldwide, commercial license to use it for your business: on your store, on marketplaces, in ads, on social media, and in print.

This license is non-exclusive. Kibley may reuse patterns, techniques, and anonymized learnings from generating your images to improve the Service, but your generated images are yours to use as described above.

You agree not to use generated images to:

• Sell them as stock photography or resell access to the Service itself.
• Misrepresent products, endorsements, or people.
• Create content that is illegal, sexual, hateful, or defamatory.
• Train competing AI models.

6. AI-generated imagery

Images generated by Kibley are created by AI and may contain inaccuracies or not perfectly represent your product. You are responsible for reviewing every generated image before using it commercially and for complying with the disclosure rules of any platform, jurisdiction, or advertising code you operate under. Some generation requests may be rejected if they violate the content policies of the AI providers we use.

7. Acceptable use

You agree not to use Kibley to generate content that is illegal, sexual, hateful, deceptive, or infringing, and not to interfere with, reverse engineer, or abuse the Service or the site. We may suspend or terminate accounts that violate these rules.

8. Intellectual property

Kibley, the Kibley logo, the site design, the underlying software, and the Service itself are owned by Kibley and its licensors. Nothing in these Terms transfers those rights to you beyond the license to your generated images described in Section 5.

9. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, Kibley disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated images will meet any specific commercial result.

10. Limitation of liability

To the maximum extent permitted by law, Kibley's total liability for any claim relating to the Service is limited to the fees you paid in the 12 months before the claim arose. Kibley is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost data.

11. Indemnification

You agree to indemnify and hold Kibley harmless from any claim, loss, or expense arising out of the material you upload or import, the way you use your generated images, or your violation of these Terms.

12. Termination

We may suspend or terminate access to the Service at any time if you violate these Terms or misuse the Service. Sections that by their nature should survive termination, including license grants, disclaimers, limitation of liability, and indemnification, will survive.

13. Governing law

These Terms are governed by the laws of Kibley's place of establishment, without regard to conflict-of-law rules. Any dispute will be resolved in the courts of that jurisdiction, unless mandatory local consumer protection laws in your country say otherwise.

14. Changes to these terms

We may update these Terms from time to time. If we make material changes we will post the new version here and update the “Last updated” date. Your continued use of the Service after changes take effect means you accept the updated Terms.
