Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of kibley.com and the Kibley AI Photoshoot (the “Service”). By placing an order or using the site, you agree to these Terms.

If you do not agree, do not use the Service.

1. The service

Kibley delivers AI-generated product photos and videos based on the reference material you upload. A standard Kibley Photoshoot includes 50 photos and 10 videos across up to 5 products, plus one free re-shoot per product.

The exact style, composition, and results of the shoot depend on the material you provide and the models we use. We do not guarantee specific creative outcomes, but we do guarantee that if you are not happy, you can get your money back. See Section 3 below.

2. Ordering and payment

The current price of a Kibley Photoshoot is $97 USD, charged once at checkout. Payments are processed by Stripe. Prices, taxes, and fees may change; the price you see at checkout is the price you pay.

Your order is confirmed once payment is successful. You'll receive an email with a link to submit your product details.

3. 14-day money-back guarantee

If you're not in love with your photoshoot, email help@kibley.com within 14 daysof delivery and we'll refund your purchase in full. No forms, no hoops.

If you request a refund, you agree to stop using the delivered photos and videos and to remove them from any place you've posted them.

4. Your content

You keep ownership of everything you upload: your product photos, brand details, and any other material. By uploading, you grant Kibley a worldwide, royalty-free license to use, store, reproduce, and modify that material for the purpose of creating and supporting your photoshoot.

You confirm that:

• You own or have the rights to the material you upload.
• Your uploads don't infringe anyone else's copyright, trademark, or privacy rights.
• The products you're shooting are legal to sell in your market.

5. Your delivered photos and videos

Once your shoot is delivered and paid for, you receive a lifetime, worldwide, commercial license to use the delivered photos and videos for your business: on your store, on marketplaces, in ads, on social media, and in print. There are no subscriptions, model royalties, or re-licensing fees.

This license is non-exclusive. Kibley may reuse patterns, techniques, and anonymized learnings from producing your shoot to improve the Service, but your final deliverables are yours to use as described above.

You agree not to use the delivered material to:

• Sell the images as stock photography or resell the shoot itself.
• Misrepresent products, endorsements, or people.
• Create content that is illegal, sexual, hateful, or defamatory.
• Train competing AI models.

6. AI-generated imagery

The photos and videos we deliver are generated by AI. The people, scenes, and details in them are not real. Kibley makes reasonable efforts to keep the likenesses generic and the scenes realistic, but you are responsible for reviewing the deliverables before publishing them and for complying with the disclosure rules of any platform, jurisdiction, or advertising code you operate under.

7. Acceptable use

You agree not to use Kibley to shoot content that is illegal, sexual, hateful, deceptive, or infringing, and not to interfere with, reverse engineer, or abuse the Service or the site. We may refuse or cancel any order that violates these rules and refund the payment.

8. Intellectual property

Kibley, the Kibley logo, the site design, the underlying software, and the Service itself are owned by Kibley and its licensors. Nothing in these Terms transfers those rights to you beyond the specific license to your delivered photos and videos described in Section 5.

9. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, Kibley disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that the deliverables will meet any specific commercial result.

10. Limitation of liability

To the maximum extent permitted by law, Kibley's total liability for any claim relating to the Service is limited to the amount you paid for the order giving rise to the claim. Kibley is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost data.

11. Indemnification

You agree to indemnify and hold Kibley harmless from any claim, loss, or expense arising out of the material you upload, the way you use the delivered photos and videos, or your violation of these Terms.

12. Termination

We may suspend or terminate access to the Service at any time if you violate these Terms or misuse the Service. Sections that by their nature should survive termination, including license grants, disclaimers, limitation of liability, and indemnification, will survive.

13. Governing law

These Terms are governed by the laws of Kibley's place of establishment, without regard to conflict-of-law rules. Any dispute will be resolved in the courts of that jurisdiction, unless mandatory local consumer protection laws in your country say otherwise.

14. Changes to these terms

We may update these Terms from time to time. If we make material changes we will post the new version here and update the “Last updated” date. Your continued use of the Service after changes take effect means you accept the updated Terms.
